Terms of Service
These Terms of Service (“Terms”) apply to all customers who purchase EV charger installation services from Maitland EV Charger Experts (“we,” “us,” “our,” or the “Company”). By accessing our website at maitlandevchargerexperts.com.au or entering into an installation agreement with us, you agree to be bound by these Terms. If you do not agree, do not use our services. These Terms were last updated on 21 July 2026.
1. Service Overview
Maitland EV Charger Experts provides EV charging equipment installation services, including supply, installation, and ongoing support and maintenance. Our services are available to residential and commercial customers in Maitland. The specific scope and cost of your installation will be detailed in your signed quote and invoice. These Terms apply to all such services unless explicitly modified in writing.
2. Installation Agreement
Your installation agreement specifies the equipment, installation date, payment terms, and scope of work. You must provide accurate information when requesting our services. We reserve the right to decline service or cancel an agreement if you provide false information or if site conditions prevent safe installation. By requesting installation, you warrant that you own or have permission to modify the property where the charger will be installed.
3. Payment
Payment for EV charger installation is due as specified in your quote and agreement. Payment must be received before installation commences unless otherwise agreed in writing. We accept EFTPOS, bank transfer, and cash. If payment is not received as agreed, we reserve the right to cancel the installation and may pursue recovery of any costs incurred.
4. Equipment Responsibility and Liability
You are responsible for the safe operation and care of the charging equipment while it is under your control. You must not modify, tamper with, or attempt to repair the equipment. You must notify us immediately of any damage, malfunction, or unusual behavior. Damage caused by misuse, neglect, or unauthorized repair may result in repair charges or termination of your agreement. We remain responsible for maintenance and repairs as outlined in your agreement. You must allow our technicians access to perform maintenance and repairs as needed.
5. Installation and Site Requirements
You are responsible for ensuring your electrical installation meets all relevant safety standards and regulations before our installation. You must provide a safe, accessible work area for our technicians. If site conditions prevent safe installation, we may decline to proceed or charge an additional fee. You are responsible for obtaining any necessary permissions or permits from your property owner, body corporate, or local council before requesting installation. We will not be liable for delays or inability to install if such permissions are not obtained.
6. Warranty and Defects
The equipment supplied is warranted to be free from defects in materials and workmanship for 12 months from the date of installation. If a defect is discovered within this period, we will repair or replace the equipment at no cost to you. This warranty does not cover damage caused by misuse, neglect, accident, unauthorized repair, or normal wear and tear.
7. User Conduct and Restrictions
You agree to use the equipment only for its intended purpose: charging electric vehicles. You must not use the equipment in a way that violates any law or regulation. You must not permit unauthorized persons to use the equipment. You must not use the equipment in a way that damages third-party property or causes injury. You must comply with all safety guidelines and operating instructions provided. Violation of these restrictions may result in immediate termination and recovery of all equipment.
8. Safety and Compliance
Our equipment complies with all relevant Australian electrical standards and safety regulations. You are responsible for following all safety instructions provided. Keep the equipment free from water, excessive heat, and physical damage. Do not attempt to use damaged equipment. Report any electrical hazards, unusual sounds, smells, or heat immediately. 9. Limitation of Liability
To the fullest extent permitted by law, Maitland EV Charger Experts is not liable for any loss of profits, revenue, data, use, goodwill, or other indirect, incidental, consequential, special, or punitive damages arising from your use or inability to use the equipment, even if we have been advised of the possibility of such damages. Our total liability to you is limited to the amount you paid for the equipment and installation. This limitation does not apply to our liability for fraud, death, or personal injury caused by our negligence, or to any consumer guarantees under the Australian Consumer Law that cannot be excluded.
10. Intellectual Property
All content on our website, including text, images, logos, and software, is owned by Maitland EV Charger Experts or our licensors and protected by copyright. You may not reproduce, distribute, modify, or transmit any content without our written permission. The equipment and its design remain the property of Maitland EV Charger Experts at all times.
11. Indemnification
You agree to indemnify and hold harmless Maitland EV Charger Experts, its officers, employees, and agents from any claims, damages, costs, or expenses arising from your use of the equipment, your breach of these Terms, or your violation of applicable law. This includes claims of property damage, personal injury, or death caused by your misuse of the equipment.
12. Exclusions from Warranty
The warranty stated in Section 6 does not cover damage or defects caused by misuse, neglect, accident, unauthorized repairs, improper installation by third parties, failure to follow operating instructions, environmental factors (water, extreme heat, freezing), or normal wear and tear. We are not responsible for service interruptions due to power outages, network failures, or causes beyond our reasonable control. Except as expressly stated in Section 6, we make no other warranties regarding the equipment.
13. Access for Maintenance and Support
You agree to provide us reasonable access to the installation site for maintenance, repairs, warranty claims, inspections, or emergency work. We will use reasonable efforts to provide advance notice unless the situation requires immediate attention for safety reasons. Failure to provide access may prevent us from fulfilling warranty obligations or providing support services.
14. Changes to Terms
We may update these Terms from time to time to reflect changes in our practices or legal obligations. If changes significantly affect your rights or obligations, we will provide notice to you at least 30 days in advance. Continued use of our services after changes become effective constitutes your acceptance of the updated Terms. 15. Dispute Resolution
Any dispute arising from these Terms or your use of our services must first be resolved through good-faith negotiation. If negotiation fails, either party may pursue resolution through the Australian courts. These Terms are governed by the laws of Australia, and both parties consent to the exclusive jurisdiction of the courts in the state where the installation is located. Nothing in these Terms limits your rights under the Australian Consumer Law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with your invoice and installation agreement, constitute the entire agreement between you and Maitland EV Charger Experts regarding the installation and supply of our services and equipment. They supersede all prior understandings, agreements, and negotiations, whether written or oral.
